RE: The tariff classification of a hat and unfinished handbag from China.

Dear Ms. Hoover:

In your undated letter you requested a classification ruling.

Three samples were submitted with your request. Style 1001A is a hat composed of plaited 100% polyester fabric. The hat has a round crown and 4” brim. Style 998 is an unfinished handbag with a handle. It is wholly of man-made textile materials.

The applicable subheading for the hat, style 1001A will be 6504.00.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, plaited or made by assembling strips of any material, whether or not lined or trimmed: Other, Not sewed: Of man-made fibers.” The duty rate will be 6.9% ad valorem.

The applicable subheading for the unfinished handbag, style 998 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Handbags, whether or not with shoulder strap…With outer shell of textile materials: Other: Other: Other, Other.” The duty rate will be 18.3% ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on style 1078. Your request for a classification ruling should include how the item is used and what manufacturing stage it is. The representative sample is not readily identifiable for any particular item or purpose. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

The hat falls within textile category designation 659 and the unfinished handbag within textile category 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
